Terms of Service

1. Agreement

These terms apply to the Wear by Weather website at wearbyweather.com and the Wear by Weather iOS app (together, the "Service"). By using the Service you agree to these terms. If you do not agree, do not use the Service.

2. What the Service is

The Service shows weather forecasts and clothing suggestions for a location, along with products offered by independent merchants on the Shopify platform. The Service is a discovery tool: we do not sell any products, process payments, hold inventory, or fulfill orders. Tapping a product takes you to the merchant's own store, and any purchase you make there is a contract between you and that merchant under the merchant's terms, prices, and policies.

3. Weather information

Forecasts come from third-party weather services and are estimates. They can be wrong, delayed, or incomplete. Outfit suggestions are general guidance generated from those estimates and are not advice for safety-critical decisions. Do not rely on the Service for protection against severe weather; consult official warnings from your local authorities.

4. Products, prices, and merchants

Product information, including prices, availability, ratings, and shipping eligibility, is provided by merchants through Shopify's catalog and can be out of date at any moment. The price and terms shown on the merchant's own store at checkout are the ones that apply. Listing a product is not an endorsement of the product or the merchant, and we are not responsible for merchandise quality, shipping, returns, or customer service on merchant stores.

5. Acceptable use

When using the Service you agree not to:

• scrape, harvest, or bulk-download content by automated means;
• interfere with the Service's operation, including probing, overloading, or circumventing rate limits or security measures;
• use the Service in violation of applicable law; or
• misrepresent the Service as your own or remove attribution from it.

6. Intellectual property

The Service's design, code, name, and logo belong to us or our licensors. Product names, images, and trademarks belong to their respective merchants and brands. Weather data belongs to its providers. Nothing in these terms grants you rights in any of the above beyond ordinary personal use of the Service.

7. The Service is provided as is

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not promise the Service will be uninterrupted, error free, or that any product shown will be available or as described.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. This includes anything arising from purchases made on merchant stores or reliance on weather information. Where liability cannot be excluded, it is limited to the amount you paid us to use the Service, which is zero.

9. Third-party links

The Service links to external sites, primarily merchant stores. We do not control them and are not responsible for their content, policies, or practices.

10. Changes to the Service and these terms

We may change, suspend, or discontinue any part of the Service at any time. We may also update these terms; the version posted here with its date is the one in effect. Using the Service after a change means you accept the updated terms.
